Medaicast1's hosting accounts may be used for
hosting business/personal web sites
and internet radio stations. While some of our customers are authors, musicians,
DJ's
and large companies, we specialize in home-based business hosting as well as
internet radio hosting.
In order to provide first-rate service to our small business clients, we have
established the following rules.
Please be advised that we do not allow:
Spam or unsolicited commercial mass e-mailing.
Sites that sell bulk emailing tools or services.
Adult or overtly sexual content of a commercial or pornographic nature.
Gaming or gambling sites.
Domain registrars.
Hate or racist sites.
Sites that defame others.
Reselling email accounts or offering free email services to the public using our mail server.
Reselling hosting accounts under your domain name.
Illegal activities, including but not limited to, copyright violations.
Distribution of Internet viruses, worms, or other destructive activities.
Other activities, whether lawful or unlawful, that we determine to be harmful to our clients, operations, or reputation.
You are responsible for ethical use of the network connectivity provided by
Mediacast1. If you have any questions about whether Mediacast1 is the right
place to host your site/station, please email us before opening your account.
You indemnify Mediacast1 for any loss suffered by reason of improper use of the
Internet connection and will compensate anyone harmed by any abusive use of the
Internet connection.
Mediacast1 will make every effort to provide an uninterrupted Internet
connection; however we do not warrant that the Internet connection will be error
free or uninterrupted. We perform full monthly and daily incremental back-ups;
however, Mediacast1 shall not be liable for any indirect, incidental or
consequential damages (including lost data, information, or profits) sustained
or incurred in connection with lost data.
In consideration for the privilege of using Mediacast1's hosting service, you
hereby release Mediacast1 from any and all claims of any nature arising from the
use, or inability to use, the Internet connection.
Mediacast1 will not review materials on our server as a matter of course, but if
it comes to our attention that you are hosting material that violates our TOS,
we will investigate and take action. We reserve the right to review any material
stored in files or programs to which other users have access, and will remove
any material that we believe may be unlawful, abusive, or otherwise
objectionable. We also reserve the right to immediately close any account that
violates our Terms of Service.
Mediacast1 reserves the right to deny access to anyone at our sole discretion.
We will not provide service to known spammers or to anyone who has provided
known false information when opening their account. We require full current
contact information from our clients, including an ISP email address and a valid
street address. Due to their association with spam and spammers, free
"throw-away" email addresses postal mail box addresses are not acceptable. We
also require that your domain name is registered to a legitimate person or
business, and that the contact information matches the contact information you
use to open your account, or that you provide written proof that you are
authorized to open an account for this domain name.
Mediacast1 reserves the right to modify the terms and conditions of this service
agreement at any time without notice. If you
do not agree to the new terms and conditions, you may cancel your account.
Mediacast1 is not responsible for legal litigation for any and all clients due
to copy write infringement cases.
Mediacast1 is not responsible for providing legal consultation of any kind,
including the following:
1. Privacy policies
2. Terms of services policies
3. Any & all lawsuit litigations
That said, we will do our best to provide fast, excellent service for all our
TOS-abiding clients!
Billing Policies
1. We accept payment made by Pay-pal, VISA, MasterCard, American Express, and
Discover.
2. Payment is due at the beginning of the term you have signed up for, and on your
anniversary date each month.
3. If paying via credit card, your account is automatically billed on your
anniversary date, if your credit card has changed,
you have 10 days before your
anniversary billing date to notify the
billing
department for any changes,
failure will result in account
suspension, service cancellations must be handled
here,
no exceptions!.
4. If a pay pal account is in arrears for over 2 days, the account will be
suspended.
5. If an account is in arrears for over 10 days, the account will be closed and
all files deleted from the server.
6. All accounts deemed fraudulent will be prosecuted to the fullest extent of
the law,
all orders are logged, we know who you are and where you live ;)
7. Any declined credit cards are suspended immediately until payment has been
resolved.
8. We do not offer refunds of any type regardless of the situation, our carriers
do not provide us with refund policies,
and therefore we are forced to pass this
policy along to our clients.
Upgrade/Downgrade Policies
1. One server type/format change per month
2. Unlimited listener upgrades per month
3. 1 listener downgrade per month
Any client who signs up for services with
Mediacast1 automatically agrees to abide and follows these terms.
